Executive Order No. 90

December 17, 1986

Identifying the Government Agencies Essential for the National Shelter Program and Defining their Mandates, Creating the Housing and Urban Development Coordinating Council, Rationalizing Funding Sources and Lending Mechanisms for Home Mortgages and for other Purposes .

 

§  Formulate national objectives for housing urban development and to design broad strategies for the accomplishment of these objectives;

§  Determine the participation and coordinate the activities of the key government housing agencies in the national housing program;

§  Monitor, review and evaluate the effectiveEXERCISE by these agencies of their assigned functions;

§  Assist in the maximum participation of the private sector in all aspects of housing and urban development;

§  Recommend new legislation and amendments to existing laws as may be necessary for the attainment of government’s objectives in housing;

§  Formulate the basic policies, guidelines and implementing mechanisms for the disposal or development of acquired or existing assets of the key housing agencies which are not required for the accomplishment of their basic mandates;

§  EXERCISE or perform such other powers and functions as may be deemed necessary, proper or incidental to the attainment of its purpose and objectives.

Strengthening the Existing Coordinating Mechanism of the National Shelter Program of the Government under EO 90, dated 17 December 1986

§  EXERCISE overall administrative supervision over the key housing agencies: NHA, NHMFC, HLURB, and HIGC

§  Be responsible for meeting targets and objectives for the housing sector, and together with the key and support housing agencies, achieve this objectives

§  Review the organization, programs and projects of the key housing agencies.

§  Decentralize its operations and of the key housing agencies by integrating the regional activities of these agencies in order to attain an equitable regional distribution of housing benefits.

§  Enlist the assistance of DBM in securing continuing funding support to the National Shelter Program and to identify and submit to the proper implementing agency projects for funding under the Philippine Assistance Program.

Urban Development Housing Act (UDHA) of 1992

 

An Act to Provide for a Comprehensive and Continuing Urban Development and Housing Program, Establish the Mechanism for its Implementation , and for Other Purposes

§  Formulate the implementing rules and regulations of RA 7279

§  Direct the formulation by HLURB in coordination with all LGUs and public and private sectors  concerned of a National Urban Development and Housing Framework

§  Design, in coordination with LGUs, a system for registration of qualified socialized housing program beneficiaries in accordance with the framework

§  Issue implementing guidelines regarding the accrual in favor of the beneficiaries of all savings  acquired through the one-stop shop processing, approval and issuance of clearances, permits and licenses on socialized housing

§  Jointly with DOF, issue implementing guidelines on  tax credit to be provided to property owners who voluntarily provide resettlement sites

§  Jointly with the DILG, promulgate the necessary rules and regulations on relocation of homeless and underprivileged citizens  in the execution of eviction and demolition orders

§  Provide LGUs , through the key housing agencies, with necessary support such as:

-   Formulation of standards, guidelines and technical support in the preparation of town and land use plans

-   In coordination with NEDA and NSO, provide data and information particularly on projections as to population and development trends in their localities, and the corresponding investment programs needed to provide appropriate types and levels of infrastructure, utilities, services and land use patterns

-   Assistance in obtaining funds and other resources needed in the urban development and housing programs in their respective areas of responsibility.

October 15, 1993

Establishing an Institutional Mechanism to Curtail the Activities of Professional Squatters and Squatting Syndicates and Intensifying the Drive Against Them

§  Serve as Co-Chairman of the National Committee Against Squatting Syndicates and Professional Squatters.  The Committee shall have the following functions:

 

a)     Oversee and coordinate government activities relative to the intensified drive against professional squatters and squatting syndicates.

b)      Recommend appropriate measures / actions to curtail the activities of professional squatters and squatting syndicates

c)     Provide assistance to LGUs in the implementation of UDHA provisions relative to squatting syndicates and professional squatters and make available through PNP and DOJ a consolidated list of squatting syndicates and professional squatters.

d)  Update the Office of the President and submit reports on the implementation of the EO. 

§  The Local Committees Against Squatting Syndicates and Professional Squatters shall provide the HUDCC and NHA copies of identified squatting syndicates and professional squatters in order to safeguard against their inclusion in future programs and projects and recommend disqualification in existing programs.

December 13, 1993

Directing HUDCC to Oversee the Implementation of a Local Government Pabahay Housing Program , and Defining the Responsibilities of Certain Agencies which will be Involved therein.

§  Coordinate and oversee the efforts of all government housing agencies involved in assisting LGUs in their respective socialized housing projects, including HDMF, HGC and NHMFC, into a coordinated and synchronized program to be known as “Local Government Pabahay Program”.

§  Conduct an intensive training program on local shelter strategy formulation for LGUS participating in the program. 

§  Chair an Advisory Committee created under the Act to ensure regular consultations with and active involvement of all sectors in the Local Government Pabahay Program.

§  In consultation with the Advisory Committee, promulgate rules, regulations and guidelines necessary to effectively implement the Local Government Pabahay Program.  Such rules, regulations and guidelines shall, among others, provide and ensure that housing projects to be supported under said program shall be low-cost in nature, to enable families with low income levels become beneficiaries thereof, and the terms and conditions of the credit or guarranty arrangement  to be granted or provided to LGUs by government housing agencies concerned shall be consistent with the pertinent guidelines of the Unified Lending Program or Expanded Housing Loan Program.

 

(Note:  The Advisory Committee is co-chaired by the CEO of HDMF with  the following as members:  DILG, NHMFC, HGC, NHA< HLURB, MMDA, Leagues of Provinces, Cities and Municipalities, and a representative from the private sector to be designated by the President)

Creating an Inter-Agency Executive Committee to Assist the Trustee Committee for the Comprehensive Development of Welfareville Property in the City of Mandaluyong 

§  Chair the Inter-Agency Executive Committee created under the EO to assist the Trustee Committee for the Comprehensive Development of the Welfareville Property in the City of Mandaluyong. 

§  The functions of the Executive Committee are as follows:

 

a)    Review and recommend to the Trustee Committee the master development plan and the terms of reference covering the dev elopement and disposition of the Welfareville property through outright sale and through joint venture development arrangement with the private sector.

b)     Together with the Trustee Committee,  conduct the public bidding following the guidelines and the terms of reference, review the outcome of the public bidding, and recommend the award for approval by the President.

§  Submit a report for the President on the conduct and result of the national registration.

Creating the Socialized Housing One-Stop Processing Centers to Facilitate the Issuance of Permits, Clearances, Certifications and Licenses Appropriate and Necessary for the Implementation of Socialized Housing Projects, and Directing All Government Agencies Concerned to Support the Operations of the Centers

§  Coordinate, monitor and EXERCISE administrative supervision over the Socialized Housing One-Stop Processing Centers (SHOPCs)

§  Determine administrative and operational costs of the SHOPC and pro-rate the contribution of each Desk to said costs.

§  Identify and call upon other government agencies or offices whose support are vital to the operations of the SHOPC.

§  Prepare and submit to the HUDCC head office, status reports on the operations and performance of the SHPC.

 

(Note:  Under EO 219, HLURB is mandated to lead the implementation of the operation of the one-stop-shop).

Shelter Financing Act of 1994

An Act Providing for the for the Comprehensive and Integrated Urban Development Financing Program by Increasing and Regularizing the Yearly Appropriation of the Major Components of the National Shelter Program, Including the Abot-Kaya Pabahay Fund Under RA 6846, Augmenting the Authorized Capital Stock of the National Home Mortgage Finance Corporation (NHMFC) and the Home Insurance Guaranty Corporation (HIGC), Identifying Other Sources of Funding and Appropriating Funds for the Purposes

§  Promulgate rules and regulations necessary for the implementation of the Act

§  Intensify the implementation of vital components of the National Shelter Program requiring government budgetary assistance, as follows: (a) resettlement program, and (b) medium- rise public and private housing

§  Together with NHA and PEA, formulate policies and guidelines, rules and regulations in the administration and management of the public rental housing facilities, in consultation with LGUs

§  Determine from time to time the income ceilings and the loanable amounts for both  levels (a) and (b) borrowers and the socialized / low-cost housing limit eligible for low development financing

Housing Loan Condonation Act of  1998

An Act to Rescue the National Shelter Program of the Government by Condoning the Penalties of All Outstanding/Delinquent Housing Loan Accounts with any of the Government Institutions and Agencies Involved in the National Shelter Program and by Amending PD 1752, as Amended

§  Promulgate the implementing rules and regulations within 60 days after the effectivitiy of the Act, together with all government institutions and agencies involved in the national shelter program (GSIS, SSS, Pag-Ibig, NHMFC and NHA),

Directing the Formulation of the National Urban Development and Housing Framework (NUDHF), 1999=2004

§  Serve as Chairman of the National Steering Committee (NSC) created for the formulation and updating of the NUDHF).  The committee shall have the following functions:

 

a)   Exercise the authority to promulgate the guidelines for the design and implementation of the formulation and updating of the NUDHF for 1999-2004.

b) Establish the appropriate coordinating and communication mechanisms necessary for the implementation of the formulation process. 

c)   Through the NSC, the HUDCC shall provide overall policy and operational directions in the formulation of the NUDHF.

d) HUDCC shall closely coordinate with the government’s shelter agencies, other national government agencies concerned, civil society  organizations and sectoral groups directly or indirectly involved in housing and urban development. 

e)  HUDCC, with assistance from HLURB, shall likewise serve as the secretariat of the NSC.

 f)   At the regional level, HUDCC shall mobilize its Regional Shelter and Urban Development Coordinating Committees (RSUDCCs) to assist in establishing the coordinating mechanism necessary for conducting relevant activities involved in the formulation process at the local level around the country.

Declaring Mass Housing as the Centerpiece Program of the Estrada Administration and Constituting the Presidential Commission for Mass Housing (PCMHS)

(Reiterate the Role of the HUDCC.  Pursuant to EO 90 (s. 1986),

§  Continue to focus on policy formulation and direction setting for the government’s shelter program, while the Presidents /  CEOs of the KSAs shall be responsible and accountable for the implementation of their respective housing programs and projects.

Establishing the Revolving Fund for Housing Projects of Local Government Units

§  Administer the revolving fund for housing projects of LGUs.  The fund shall be in the initial amount of P100 million to be made available for the first 10 LGUs which will submit a concrete housing project with identified poor housing beneficiaries as a maximum amount of P10 million per LGU.

Creating the National Police Task Force to Curtail the Proliferation and Activities of Professional Squatters and Squatting Syndicates

§  Chair the Task Force which is directed to coordinate with the National Committee Against Squatting Syndicates and Professional Squatters (NDAPSSS).  

§  The Task Force functions include the identification of professional squatters and squatting syndicates including the names of public officials and/or private individuals or companies abetting or tolerating the commission of the act.

Creating a Presidential Housing Assistance One-Stop-Shop Center (Presidential HAOS-Center) to Provide Assistance to Beneficiaries and Developers of Socialized and Low-Cost Housing Projects

§  The Presidential HAOS-Center, which will be under the direct supervision of the Presidential Commission for Mass Housing (PCMH), shall be based in the Presidential Management Staff and shall be manned by a composite team of representatives from the PMS, HUDCC and line departments and agencies involved in housing.

Redirecting the Functions and Operations of HUDCC and All Housing Agencies

§  HUDCC to be involved in staff functions; render technical, secretariat and other support services to the PCMH.

§  Serve as the lead agency to assist the President and the PCMH in formulating the national objectives, policies and strategies for housing and urban development, and in designing broad strategies for the accomplishment of the government’s housing objectives.

§   Serve as the lead agency to assist the President and the Presidential Commission for Mass Housing (PCMH) in formulating the national objectives, policies and strategies fro housing and urban development.

§  Jointly with NEDA, determine the respective ceilings for socialized, low-cost, medium-cost, and open housing loan ceilings, to be reviewed once every 2 years to conform to prevailing economic conditions

§  Together with DOF and DBM, provide inputs to HGC which has been tasked under the law to promulgate the rules and regulations for the implementation of the act.

Instituting the National Drive to Suppress and Eradicate Professional Squatting and Squatting Syndicates, Amending EO 178, s. 1999 and EO 129, s. 1993, and for Other Purposes

§  Take the lead in the identification of professional squatters and squatting syndicates, monitor and launch operations through the proper agency or body, to curtail their operations.

§  The National Committee Against Squatting and Squatting Syndicates established under EO 129 (October 1`5, 1993) is abolished.,  All functions thereof are transferred to the HUDCC.  Any reference to the National Committee shall be read as referring to HUDCC. 

§  With DOJ, have authority to call on government agencies to give their full support, assistance and cooperation in the course of the implementation of the provisions of the EO. 

§  The National Police Task Force (NPTF) to Apprehend Squatting Syndicates and Professional Squatters created under EO 178 (23 November 1999) is strengthened.  It shall serve as the operational arm of HUDCC in his drive against professional squatters and squatting syndicates.  The PNP is directed to designate full-time staff to the NPTF.

§  With DOJ, to submit regular reports to the Executive Secretary relative to the implementation of the provisions of the EO.

§  Jointly with DOJ, in consultation with relevant agencies and stakeholders, formulate and adopt guidelines for the effective implementation of the EO.

Directing the Housing and Urban Development Coordinating Council to Directly Oversee and Fast- track the Implementation and Development of Housing Projects in Areas Proclaimed as Housing Sites

§  Oversee and fast-track through appropriate project schemes and contractual arrangements, subject to existing laws, rules and regulations, the implementation and development of housing projects in the areas proclaimed as housing sites.

Authorizing the Creation of the Social Housing Finance Corporation (SHFC) and Directing the Transfer of the Community Mortgage Program, Abot-Kaya Pabahay Fund Program, and other Social Housing Powers and Functions of the NHMFC to the SHFC

§  A transfer committee composed of the HUDCC Chairman, NHMFC President, a DBM representative, and 2 HUDCC representatives shall prepare the necessary plans and measures to effect the transfer of all assets, liabilities and records of the CMP and the AKPF Program (modernization support program and the developmental financing program) to the SHFC within 30 days from the issuance of the EO.

§  HUDCC and other government agencies shall constitute the Inter-Agency Committee that will oversee the preparation of the Master Development Plan of the NBP site and will issue the necessary IRRs consistent with the proclamation and other previous Presidential Directives.

§  Formulate and implement an intensive advocacy program for social acceptance and support of stakeholders on urban asset reform program; and

 

§  Facilitate the preparation of a framework that will enable newly formalized poor owners and small entrepreneurs to form new productive ties and networks with each other and with other sector parties.

Strengthening Proclamation No. 1637, s. 1977, which Declares the Lungsod Siilangan Townsite Reservation, and Designating the LGUs of Antipolo, San Mateo and Rodriguez, all in the Province of Rizal, as Administrator of Areas Identified as New Townsite for Government Employees of Metro Manila and the Rizal Province

§  Assist the LGUs concerned in the formulation of development plans and implementing guidelines for the new town housing projects of each locality.

Approving the 2008INVESTMENT Priorities Plan (IPP)

§  The 2008 IPP states that existing companies in the socialized and low-cost housing sector undergoing new projects in the same sector are entitled to income tax holiday (ITH), while vertical mass housing projects located in Metro Manila are entitled to diminishing rate of ITH as determined in the specific guidelines.

§  Additionally, power generation projects utilizing indigenous and renewable energy sources and other energy sources adopting environmental-friendly technologies are also entitled to ITH.  New power generation projects are entitled to diminishing ITH rate of exemption (100% for the first project and 5% reduction for every succeeding project).
